Hidama / EchoGap
本利用規約(以下「本規約」)は、mariecraftworks(以下「運営者」)が提供するモバイルアプリケーション「Hidama」(英語版名称: EchoGap。以下「本アプリ」)の利用条件を定めるものです。利用者は、本アプリを利用することにより、本規約に同意したものとみなされます。
本アプリは、利用者が端末に保有する音声ファイルを読み込み、波形の表示、無音区間に基づくセンテンス分割、およびリピーティング練習の機能を提供する語学学習支援アプリです。
運営者は、利用者に対し、本規約に従うことを条件として、本アプリを個人的かつ非商業的な目的で利用する、譲渡不能かつ非独占的な権利を許諾します。本アプリに関する著作権その他一切の知的財産権は、運営者または正当な権利者に帰属します。
本アプリは音声コンテンツを配信・提供するものではなく、利用者自身が用意した音声ファイルを読み込んで利用するものです。
利用者が本アプリで使用する音声ファイルについては、利用者自身が適法に入手し、私的使用の範囲内で利用するなど、著作権法その他の法令を遵守する責任を負うものとします。利用者による音声ファイルの利用に起因して第三者との間で紛争が生じた場合、利用者は自己の責任と費用においてこれを解決するものとし、運営者は一切の責任を負いません。
本アプリの一部機能は、アプリ内購入(買い切り型)によって利用可能になります。購入に関する決済は、Google Play または Apple の App Store を通じて行われ、各ストアの利用規約が適用されます。
購入した機能は、同一のストアアカウントであれば、機種変更後も各ストアの復元機能により再度有効化できます。返金については、各ストアの返金ポリシーに従うものとします。
利用者は、本アプリの利用にあたり、以下の行為を行ってはなりません。
運営者は、本アプリについて、その完全性、正確性、有用性、特定目的への適合性を保証しません。以下の点についてあらかじめご了承ください。
運営者は、本アプリの利用または利用不能に起因して利用者に生じたいかなる損害についても、運営者に故意または重過失がある場合を除き、責任を負いません。なお、消費者契約法その他の強行法規の適用により免責が認められない場合、運営者の責任は、利用者が本アプリのアプリ内購入に対して支払った金額を上限とします。
運営者は、利用者への事前の通知なく、本アプリの内容の変更、アップデート、または提供の終了を行うことができます。これにより利用者に生じた損害について、運営者は前条の定めに従い責任を負いません。
運営者は、必要に応じて本規約を変更することができます。重要な変更がある場合は、本ページにて改定内容と改定日を告知します。変更後に利用者が本アプリの利用を継続した場合、変更後の規約に同意したものとみなされます。
本規約は日本法に準拠し、解釈されるものとします。本アプリに関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use ("Terms") govern your use of the mobile application "EchoGap" (Japanese edition name: Hidama; hereinafter "the App"), provided by mariecraftworks ("the Operator"). By using the App, you agree to be bound by these Terms.
The App is a language-learning support tool that loads audio files stored on your device and provides waveform visualization, automatic sentence segmentation based on silence detection, and repeating-practice features.
Subject to these Terms, the Operator grants you a non-transferable, non-exclusive license to use the App for personal, non-commercial purposes. All copyrights and other intellectual property rights in the App belong to the Operator or their rightful owners.
The App does not distribute or provide any audio content. It works exclusively with audio files that you provide yourself.
You are solely responsible for ensuring that your use of any audio file with the App complies with copyright law and other applicable laws — for example, by using only lawfully obtained files within the scope of personal use. If any dispute arises with a third party in connection with your use of audio files, you shall resolve it at your own responsibility and expense, and the Operator shall bear no liability.
Certain features of the App are made available through a one-time in-app purchase. Payment is processed by Google Play or the Apple App Store, and the terms of the respective store apply.
Purchased features can be re-enabled after a device change through the store's restore function, provided you use the same store account. Refunds are subject to the refund policy of the respective store.

The App is provided "as is." The Operator makes no warranty as to its completeness, accuracy, usefulness, or fitness for a particular purpose. In particular, please note the following:
Except in cases of willful misconduct or gross negligence, the Operator shall not be liable for any damages arising from your use of, or inability to use, the App. Where mandatory law (such as consumer protection law) does not permit such exclusion, the Operator's total liability shall be limited to the amount you paid for the App's in-app purchase.
The Operator may change, update, or discontinue the App at any time without prior notice. The Operator's liability for any resulting damages is governed by the preceding section.
The Operator may revise these Terms as necessary. If material changes are made, the revised content and revision date will be announced on this page. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
